- Preclear helps you prepare. It is not the government, and it cannot grant, deny or guarantee a clearance.
- You are responsible for the truth of everything you submit on an SF-86. Review every field before you use it.
- Use Preclear only for your own record.
- Employers may use the marketplace only to recruit, and never as a background check.
- Your data stays yours. You can export it or delete it at any time.
The agreement
By creating an account or using Preclear, you agree to these Terms and to our Privacy Policy. If you use Preclear for an organization, such as an employer, you confirm that you have authority to bind that organization, and “you” includes it. If you don't agree, don't use Preclear.
What Preclear is and isn't
Preclear gathers your records with your permission, pre-fills your SF-86, shows where each answer came from, and estimates your readiness against the published adjudicative guidelines (SEAD 4). It also runs an optional marketplace that connects ready candidates with verified employers.
Preclear is not:
- a U.S. government agency, or affiliated with or endorsed by DCSA, OPM, ODNI or any agency that investigates or adjudicates;
- a way to submit your SF-86. You submit through the government's system yourself;
- a clearance, an eligibility decision, or a prediction the government must follow. A readiness estimate is not a determination, and the final decision is always the government's;
- legal, financial or mental-health advice;
- a consumer reporting agency. Readiness estimates and marketplace profiles are not consumer reports.
Who can use it
You must be at least 18 and able to enter a binding contract. The applicant side of Preclear is for your own record only. You may not create a file for anyone else, or enter another person's identifiers except where the SF-86 asks for them, such as relatives and references. Employer accounts must pass our verification before they can see the marketplace.
Your account
Keep your password and second factor to yourself. You're responsible for activity on your account. Tell us right away at [email protected] if you think someone else has used it. We'll email you about sign-ins from new devices and every credential change.
Accuracy of your file
Preclear proposes answers from your records and interview. You decide what goes on your SF-86. Records can be wrong, incomplete or about someone else, and Preclear's matching is not perfect. Check every value before you use it.
A knowingly false statement or omission on an SF-86 can be punished under federal law (18 U.S.C. § 1001). Relying on a value Preclear proposed does not excuse it. If you find an error in a source record, correct it with the source. Preclear can show you where it came from.
Your data and our license
You own your file and everything you give us. You grant Signet a limited license to host, process and display that information only to provide Preclear to you, as described in the Privacy Policy. That includes sharing your anonymous profile with verified employers if you opt in. This license ends when you delete the data or your account, except for any copy you have already sent to someone.
If you send us feedback or suggestions, we may use them without owing you anything. We won't identify you publicly as the source without your permission.
The marketplace
For candidates
Listing is optional and takes a separate consent. Your profile is anonymous until you accept an introduction, and you can pause or withdraw it at any time. A listing is automatically hidden when your consent is revoked or your data is out of date. We don't promise that any employer will contact you or offer you a job.
For employers
If you use the marketplace as an employer, you agree to all of the following:
- You'll use it only to recruit for real openings at your organization. You won't resell, share or scrape profiles.
- You won't treat a Preclear profile or readiness estimate as a consumer report, a background check, or a substitute for the government's investigation. You won't use it as a basis for an eligibility, hiring, pay or firing decision governed by the Fair Credit Reporting Act.
- You won't try to identify an anonymous candidate before they accept your introduction, or contact them outside Preclear before then.
- You'll comply with equal-employment, anti-discrimination and privacy laws, and keep candidate information confidential. You'll delete it when you no longer need it for recruiting.
- Your verification details are accurate, and you'll tell us if they change.
If you break these rules, we can remove your access right away and tell affected candidates.
Acceptable use
Don't:
- access another person's file, or try to get past consent, verification, rate limits or other security controls;
- probe, scan or test Preclear's vulnerabilities, except under our disclosure policy;
- use bots or scrapers, or overload the service;
- upload malware, or content you have no right to share;
- impersonate anyone, or misrepresent your affiliation with an agency or employer;
- use Preclear to break any law, including export-control, privacy or computer-fraud laws.
Software license
This section is the end-user license for the Preclear web app and anything you download from it, including your handoff package, a filled SF-86 PDF and a Preclear card for Apple Wallet. Signet grants you a personal, non-exclusive, non-transferable, revocable license to use Preclear and those downloads for your own clearance preparation, as long as you follow these Terms.
You may not copy, modify or distribute Preclear's software. You may not reverse engineer, decompile or disassemble it, except where the law allows despite this restriction. You may not remove proprietary notices, or use Preclear to build a competing service. Documents generated from your own data are yours to use as you see fit. The Signet name, marks and software stay the property of Signet Systems. Official government forms remain government works.
Third-party services
Some features connect to other services: your email provider, your bank through Plaid, identity verification, and the record sources themselves. Their terms apply to your use of them. We're not responsible for their availability, accuracy or practices. We only access them as you authorize, and you can disconnect at any time.
Fees
Preclear is free for applicants during early access. If we introduce paid features, we'll show you the price and ask you to agree before you're charged. Employer pricing, where it applies, is set out in a separate order or agreement.
Suspension and termination
You can stop using Preclear and delete your account at any time from the app. We may suspend or end your access if you break these Terms, if the law requires it, or to protect other users or the service. Where it's appropriate, we'll give you notice and a chance to export your file first. The sections that by their nature should survive termination will survive, including licenses you granted for data already shared, disclaimers, limits of liability and indemnity.
Disclaimers
Preclear is provided “as is” and “as available.” To the extent the law allows, Signet disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that Preclear will be uninterrupted or error-free, or that any record, pre-filled answer or readiness estimate is complete or correct. We also don't warrant that using Preclear will lead to a clearance, a faster investigation or a job.
Limitation of liability
To the extent the law allows, Signet is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities or an adverse clearance decision arising from your use of Preclear. Signet's total liability for any claim relating to Preclear is limited to the greater of the amount you paid Signet in the 12 months before the claim or US $100. Some jurisdictions don't allow these limits, so they may not apply to you in full.
Indemnity
If you use Preclear as an employer, or break these Terms, you'll defend and indemnify Signet against third-party claims that result, including reasonable legal fees.
Governing law and disputes
These Terms are governed by U.S. federal law and the laws of the State of [governing state], without regard to conflict-of-laws rules. Before filing a claim, please contact us so we can try to resolve it informally within 30 days. Any claim that isn't resolved goes to the state or federal courts located in [governing state], and both parties consent to their jurisdiction. Either party may bring a claim in small-claims court if it qualifies.
General
These Terms, together with the Privacy Policy and any employer order, are the whole agreement between us about Preclear. If a court finds any provision unenforceable, the rest still applies. If we don't enforce a term, we haven't waived it. You may not transfer these Terms without our consent. We may transfer them as part of a merger or acquisition, and we'll notify you if we do.
We may update these Terms. If a change is material, we'll give you at least 14 days' notice by email or in the app. If you keep using Preclear after that, you accept the new terms. If you don't accept them, you can delete your account before they take effect.
